Terms of Service

1. Acceptance of Terms

By accessing or using Zimsika ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform. These terms apply to all users including buyers, sellers, and visitors.

2. Platform Description

Zimsika is an online marketplace that connects buyers and sellers across Zimbabwe. We provide the technology platform but are not a party to transactions between buyers and sellers. Sellers are independent businesses responsible for their own products and fulfilment.

3. Account Registration

You must create an account to buy or sell on Zimsika. You must be at least 18 years old. You are responsible for maintaining the security of your account credentials. You must provide accurate and complete information. One person may only hold one account.

4. Buyer Terms

• Prices are in USD and include applicable taxes
• Payment is required at checkout (except COD orders)
• You must provide accurate delivery information
• You must be available to receive your delivery
• Fraudulent chargebacks will result in account suspension

5. Seller Terms

• You must complete identity verification (KYC) before receiving payouts
• You are responsible for the accuracy of your product listings
• You must fulfil orders within your stated processing time
• Zimsika charges a commission on each sale (see platform settings)
• You must not list prohibited items (see Section 7)
• Repeat order cancellations may result in account suspension

6. Fees & Payments

Zimsika charges sellers a commission on each completed sale. This commission is deducted before releasing funds to the seller wallet. Payout requests are processed within 2–5 business days. Zimsika reserves the right to adjust commission rates with 30 days notice.

7. Prohibited Items

• Weapons, firearms, and ammunition
• Illegal drugs and controlled substances
• Counterfeit or stolen goods
• Adult content or services
• Live animals
• Recalled or unsafe products
• Currency, financial instruments, or cryptocurrency
• Items that infringe intellectual property rights

8. Intellectual Property

All content on Zimsika including logos, designs, and software is owned by Zimsika or its licensors. Sellers retain ownership of their product images and descriptions but grant Zimsika a licence to display them on the platform and in marketing materials.

9. Limitation of Liability

Zimsika provides the platform "as is" without warranties. We are not liable for the quality, safety, or legality of products sold by third-party sellers. Our total liability to you shall not exceed the amount you paid for the transaction in question.

10. Dispute Resolution

Disputes between buyers and sellers should first be resolved directly. If unresolved, either party may escalate to Zimsika Support. Zimsika's decision on platform disputes is final. Legal disputes shall be governed by the laws of Zimbabwe and heard in Harare courts.

11. Account Termination

Zimsika may suspend or terminate accounts that violate these terms, engage in fraud, receive excessive negative reviews, or harm other users. Sellers with suspended accounts may request their wallet balance after any pending disputes are resolved.

12. Changes to Terms

We may update these terms from time to time. Continued use of Zimsika after changes are posted constitutes your acceptance of the new terms.
